In 2001, the EPA established a goal to further reduce the sulfur content in diesel used in the transport sector.  This legislation, collectively known as the "Highway Diesel Rule", was enacted to reduce 90% of the pollution created by diesel vehicles.  As a result, the Low Sulfur Diesel (LSD) and Ultra Low Sulfur Diesel (ULSD) standards were created.  In 2004, the “Clean Air Non-road Diesel Rule” was enacted to reduce pollution from off-road distillate engines using similar standards.  The new regulations, covering the current transition from Low Sulfur Diesel (LSD) to Ultra Low Sulfur Diesel (ULSD ), require a whole new group of companies to file compliance reports with the EPA.  These reports are collectively known as the “Designate & Track” (D&T) reporting and record-keeping requirements of the new regulations.  

Prior to the new regulations, non-road and motor vehicle (MV) diesel were clear and fungible until the final point of distibution where they were dyed different colors.  To avoid dying of the products before entering the distribution system the producers and shippers requested the ability to ship Non-Road Locomotive and Marine (NRLM) diesel without dye so that it would not have to be segregated from on-road until near the point of sale.  In return for the operational flexibility to avoid moving dyed product throughout the system, the EPA requires compliance reports to be filed by the parties who transfer custody of Ultra Low Sulfur Diesel (ULSD) to show how much of the product initially “designated” as Ultra Low Sulfur Diesel (ULSD) was received, how much was “redesignated” as a different type of product, and how much was handed off to the next party in the custody chain.  These reporting and record-keeping obligations continue until the product is moved to a retail sales location or is dyed to create a segregated product that is no longer part of the fungible pool.

DieselTrakker™ has been designed to simplify these EPA reporting requirements by collecting, organizing, and creating the reports required for distillate fuels imported, produced, blended, and transported in the U.S. market.  DieselTrakker™ can be used by refiners, importers, blending facilities, terminal operators, pipelines, barge operators, and other logistics providers (truck, rail).  The system can track biodiesel, Low Sulfur Diesel (LSD), Ultra Low Sulfur Diesel (ULSD), Motor Vehicle, Non-Road, Locomotive & Marine (MVNRLM) fuel, and other distillates through the entire custody chain.  It performs the calculations required to report hand-offs between custodians, product tracking, inventory reporting, product downgrading, product shifting and volume balancing requirements.  It differs from existing terminal Volume Management Systems (VMS) and accounting systems in that it "translates" VMS information into the regulatory codes that have to be used for filing, and keeps all regulatory information in one database.

DieselTrakker™ generates the compliance reports including:
  • Diesel Fuel Sulfur Batch Report (DSF0401)
  • D&T Handoff Report (DSF0500)
  • D&T Total Volume Report (DSF0600)
  • D&T Facility Compliance Calculation Report. (DSF0700)
Each EPA registered entity in the distillate distribution chain is required to file some or all of the above reports to the EPA on a Quarterly and/or Annual basis.  The Motor Vehicle (MV) reporting began in June 1, 2006.  The Non-Road Locomotive Marine (NRLM) (otherwise known as off road diesel), heating oil and other distillate product reporting and record-keeping program began June 1, 2007.  The first recordkeeping reporting period for companies who only handle off-road diesel began June 1, 2007, with the first set of quarterly reports due November 30, 2007.

System Overview

The DieselTrakker™ suite consists of two main applications:

DieselTrakker™ is a database and reporting system that allows automatic upload or manual entry of required regulatory data, stores the data, and generates the required reports. The reports include management reports to monitor performance throughout the reporting period and the formatted files required for filing with the EPA.

CrossTrak™ is a web service based software that exchanges D&T hand-off information with counterparties to ensure reporting volumes are in balance before filing.  If the counterparty is a DieselTrakker™ client, the software can automatically update the records with the transaction confirmation status. The system automates the confirmation process without the need for e-mail and minimizes the number of exceptions requiring manual review.  This automated process reduces the time needed for comparing information with other companies and minimizes undesired scrutiny by the EPA due to information mismatches.
